تمثل ظاهرة الإجهاض إحدى الظواهر الخطيرة التي تهدد استقرار الأفراد والمجتمعات في العالم أجمع، ولقد دلت الإحصاءات الرسمية الصادرة عن منظمة الصحة العالمية أن حالات الإجهاض التي تقع كل عام تتراوح بين 42 و60 مليون حالة، وهي في إزدياد مستمر. وتعد العلاقات الجنسية غير الشرعية إحدى الأسباب الرئيسة لانتشار هذه الظاهرة وتفاقمها، مما ينتج عنها قتل الملايين من الأجنة كل عام سواء من خلال المستشفيات والمراكز الصحية أو حتى الوسائل التقليدية. ويعاني العالم الإسلامي أيضاً من هذه الظاهرة في غياب إحصاءات رسمية تبين نصيب المجتمع الإسلامي من ظاهرة الإجهاض، مع التأكيد على تصاعد هذه النسبة بالنظر إلى عدد الأجنة التي تكتشف في أماكن مختلفة بين الحين والآخر. ولقد جاء هذا البحث لدراسة ظاهرة الإجهاض وعلاقته بالعلاقات الجنسية المحرمة، وبيان خطورة الزنا على الفرد والمجتمع، ثم بيان حكم الإجهاض عموماً، وبعد ذلك سلط الضوء على حكم إجهاض الحمل غير الشرعي عند العلماء القدامى منهم والمعاصرين، مع بيان أدلة كل فريق، وبيان الراجح من الأقوال حسب ما رأه الباحث.
Abstract
Abortion continues to be a very controversial and complex issue given its political, religious, ethical and health dimensions which often lead to heated debates among scholars. The research sheds new light on the reality of abortion and pre-martial sex as its major factor. According to the statistics of the World Health Organization, 42 to 60 million abortions are performed in the world each year in hospitals and clinics, or even through traditional and primitive means. This research investigated the legal position of abortion in general, as well as the legality of abortion of the illegitimate pregnancy in the light of Islamic jurisprudence, and the position of the Muslim Scholars both traditionalist and contemporary with special attention to demonstrating the most accurate based on strong legal evidences.
