| description | الفروق الفقهية نوع من أنواع الفنون الإسلامية والعلوم الشرعية، وهي تعتني ببيان وجه الفرق بين المسائل الفقهية المتشابهة بغية الحيلولة دون التسوية بينها في الحكم الشرعي. وقد تناول العلماء الفروق الفقهية في كتاباتهم ودراساتهم، فمنهم من أفردوها في كتب مستقلة تخص بها، ومنهم من أدرجوها ضمن حديثهم عن المسائل الفقهية. وممن سلك هذه الطريقة الثانية الإمام الشيرازي في كتابه المهذب في الفقه الشافعي، إذ تطرق إلى الفروق الفقهية أبان تناوله للمسائل الفقهية المبنية على أصول المذهب الشافعي. ويسعى هذا البحث إلى استخلاص الفروق الفقهية المتناثرة في هذا الكتاب أولا مع التركيز على بعض المسائل الفقهية المتعلقة بالطهارة، ثم دراسة منهج الإمام الشيرازي في التفريق الفقهي مبينا الأصول الشرعية التي اعتمد عليها في هذه الفروق. يتألف هذا البحث من مبحثين حيث يتعرض المبحث الأول الفروق الفقهية في الطهارة من كتاب المهذب للشيرازي، ويتصدى المبحث الثاني إلى منهج الشيرازي في التفريق بين المتشابهات الفقهية من مسائل الطهارة
The Science of Juristic Variations is one of the branches of Islamic Sciences, which studies
the differences between similar juristic rulings. The jurists have been studying this kind of
science in their writings. Al-Shirazi is one of them, and he has tackled a number of juristic
variations in his book of al-Muhazzab. The researh attempts to collect these juristic variations
from this book by emphasizing on the matters relating to purity (al-Toharah). In addition, the
research studies the method used by al-Shirazi in differentiating the similar rulings and the
evidences which indicate these variations. The research consists of two chapters, where the
first chapter handles the collection of juristic variations from al-Shirazi’s book of alMuhazzab,
and the second chapter points out al-Shirazi’s method in juristic variations. |
