وقد ذكر الشارع أحكامه في نصوصه وهي متفقة مع ما يدركه العقل الإنساني من أن المتشبهات تأخذ حكماً فقهياً واحداً، وأن التشابه الذي يراه العقل في تصوره للأشياء مناطٌ للتساوي في الحكم بينها عند الشارع. وعلى عكس هذا، فثمة ما يلاحظه المكلف من أن الشارع فرَّق في نصوصه بين الأشياء المتشابهة في أحكامها الفقهية...
