Various types of Internet based communications, particularly online news portals have been resorted to publish alternative news and comments that are not covered by the mainstream media. Unfortunately, online news portals are currently not subjected to any statutory controls. Furthermore, the existence of the no censorship guarantee seems to suggest that Internet based communications including online news portals will not be requested to comply with the licensing systems that apply to the traditional media. This scenario is definitely undesirable as online news portals may be exploited to channel hatred and spread lies by unscrupulous individuals. Thus, this study will discuss the legal background of the traditional media in Malaysia, analyse the existing statutory provisions and examine the probability of applying these provisions to control online news portal in Malaysia. The study is largely based on doctrinal research as it is primarily concerned with the review of the existing rules and regulations that are likely to be applicable to online news portals and formulate possible solutions to address the uncertainties of online news portals. As such, the study will conduct critical analyses of the primary sources of law which are to be found in statutes and cases, as well as the secondary sources including text books, scholarly articles from refereed journals and seminar papers presented at relevant conferences. In addition, reference will also be made to newspaper articles, periodicals and information gathered from reliable websites that reflect the latest development on the subject matter. To sum up, it is submitted that online news portals in the country should not be left unregulated nor treated as a legal vacuum 2nd International Conference on Media and Society Universiti Malaysia Sarawak
